Can I be sued for this?

So Myspace just recently came out with their MyAds Beta platform in which you can run banner ads and 300×250 ads to Myspace users.

Now, what I did was create a 300×250 ad in Photoshop. I went to a website and found a picture of a girl for a dating ad I’m running. Does it also depend on what her age is?

Is this illegal? I mean, after all, the internet is public and I should be able to use any image that I find.

It would be illegal for you to use the photo without permission. However, were the copyright owner of the photo to discover your ad, it is more likely that you would be requested to stop using the photograph rather than be sued.
